1. Acceptance of the terms
Access to, browsing of, registration on and use of Avisosex implies acceptance of these Terms and Conditions.
If the user does not agree with them, the user must refrain from using the site and its related services.
2. Age requirement
The site is intended exclusively for persons over 18 years of age.
By registering, publishing content, using messaging or video calling, the user declares under their own responsibility that they meet the applicable legal age requirement.
3. Nature of the service
Avisosex is a digital platform for publishing listings, profiles, blog content and user contact tools, available through the website and the mobile application.
The site does not provide sexual services, does not represent users, does not guarantee commercial outcomes and does not participate in private agreements, meetings, payments or negotiations between third parties.
4. User account and access
To use certain functions, the user must create an account with truthful, updated and sufficient information.
The user is responsible for the confidentiality of their credentials, the use of their account and all activity carried out through it on both the website and the mobile application.
5. User publications and content
The user is solely responsible for the content they publish or share on the platform, including listings, blog posts, comments, text, images, videos, audio, messages, links and contact data.
The user declares that they hold the rights, authorizations and consents necessary to publish such content.
6. Instant messaging and video calls
The platform may provide instant messaging, file sharing, voice calling or video calling tools between users.
These functions are provided as technical means of communication and are used under the sole responsibility of the users involved.
It is prohibited to use these functions for harassment, threats, extortion, impersonation, grooming, non-consensual distribution of content, spam, fraud or any illegal activity.
Unless all parties have given express and legally valid authorization, users must not record, distribute or reuse private communications conducted through the platform.
7. Prohibited content
- Content involving minors or the appearance of minority age.
- Material promoting exploitation, trafficking, abuse, coercion or violence.
- Illegal, fraudulent, defamatory, misleading content or content infringing third-party rights.
- Malware, malicious links, spam, abusive automation or attempts to compromise the platform.
- Third-party personal data published without sufficient legal basis or consent.
- Recordings or captures of private communications without valid authorization.
8. Artificial intelligence generated content
It is not permitted to publish images, videos, audio or profiles generated or altered by artificial intelligence when they mislead as to a person identity, age, consent or real existence.
- Impersonate real people.
- Use deepfakes or deceptive synthetic identity.
- Simulate third-party consent.
- Depict minors or apparent minority age.
9. Moderation and compliance
Avisosex may review, restrict, unpublish, suspend or remove content, accounts or functionalities when it detects evidence of breach of these terms, the law or internal security and moderation policies.
The platform may also retain technical logs and cooperate with competent authorities where legally required.
10. Payments and premium services
The site may offer paid services, premium plans, highlighting features or other commercial tools.
Contracting such services does not guarantee contacts, conversions, income, minimum views or any specific result.
11. Availability and limitation of liability
Avisosex seeks to keep its services operational, but does not guarantee continuous availability, absence of errors, full compatibility with every device or uninterrupted connectivity in messaging and video calling.
The user uses the platform at their own risk. Avisosex is not liable for acts, omissions, agreements, payments, meetings or damages arising from relationships between users.
12. Intellectual property
Distinctive signs, design, code, proprietary texts, interfaces and platform elements belong to their respective owners and are protected by applicable law.
The user retains rights over their content, but grants the platform a non-exclusive authorization to host, process, display, technically adapt and moderate it for the purpose of operating the service.
13. Privacy and personal data
Personal data processing is governed by the platform Privacy Policy and applicable Chilean law, including Law 21.719.
The use of the blog, the mobile application, messaging, video calling and other features may involve the processing of technical and operational data required to provide the service, keep sessions active, send notifications and maintain security.
14. Changes to the terms
Avisosex may modify these Terms and Conditions to reflect legal, regulatory, operational or technological changes.
The current version will be the one published on the platform and will apply from publication unless a different effective date is indicated.
15. Governing law and jurisdiction
These Terms are interpreted in accordance with the laws of the Republic of Chile.
Any dispute will be heard by the competent courts of Santiago, Chile, without prejudice to mandatory consumer rules or other special applicable legislation.
